These Terms of Service ("Terms") govern your use of the Dealfair website, mobile application, and related services provided by Dealfair (collectively referred to as the "Platform"). This agreement outlines your privileges and duties when utilizing Dealfair and our Service (the "Service" encompasses the "Website" and the mobile device application, the "App"). To access most functionalities of the Service, registration for an Account with us (an "Account" or "Dealfair Account") is required. By accessing or using the Platform, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use the Platform.
We retain the right to revise the Terms at any juncture by publishing an updated version on our website. The updated version will take effect upon its publication. Should we modify the Terms in a manner that diminishes your entitlements or increases your obligations, we will furnish you with notification.
1. Account Registration
To use certain features of the Platform, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
Here are a few guidelines about Dealfair Accounts:
- A User must not employ a Dealfair Account for money laundering, illegal purposes, or violating any law, regulation, or provision of these Terms. As a requirement for using the Service, we hold all Buyers or Sellers accountable for law violations, these Terms, and all applicable policies.
- You must be at least 18, or the age of legal adulthood in your state of residence, to possess a Dealfair Account.
- You are solely accountable for any activity and listings linked to your Dealfair Account.
- Your responsibility is to maintain accurate User Information on your account, including contact details like phone number, email, and mailing address. You may be requested to update or authenticate this information periodically to facilitate the continued servicing of your account by Dealfair.
- You are liable for any fees, chargebacks, Buyer refunds, or payment reversals received by Dealfair, even if you close your account. Amounts owed to Dealfair or others may be deducted from your balance or collected via an invoice from Dealfair, which you will be required to settle or which may be managed by a collections agency.

2. Description of the Service
- The Service operates as an online marketplace focusing on consumer-to-consumer transactions. Dealfair offers a singular Account type, exclusively catering to individuals, and does not cater to specialized products to accommodate businesses or other entities like non-profit organizations.
- Dealfair does not directly sell or purchase goods, nor does it take physical possession of goods on its own behalf or on behalf of Users or other parties. While Dealfair may facilitate transactions, Users who create listings and sell items through the Service ("Sellers") and Users who make purchases through the Service ("Buyers") assume complete responsibility for their transactions involving the sale of goods (referred to as "goods," "products," or "items"). This includes the listing of goods and any applicable product warranties. In this document, Sellers and Buyers are collectively called "Users" of the Service.
- Suppose you manage your tax filings or operate your Dealfair Account under an alternate tax entity, such as an LLC, Sole Proprietorship, or another entity type. All policies, regulations, and usage conditions outlined in these Terms and associated procedures will apply to your Dealfair account. Only one account per entity or individual is permissible. For this document, all definitions provided herein shall apply to your account, irrespective of your entity status outside our Service.
- Dealfair offers payment processing services through third-party service providers for items listed on its marketplace. Here at Dealfair, we use payment methods, including American Express, Discover, Visa, and Master. Sellers can deposit sales proceeds into their designated bank account through Stripe Connect and proceed with transactions and withdrawals through the Dealfair platform. To make your transaction smooth, you have to use the same account you have been using for creating a Stripe Connect account.
Please note that the Dealfair platform doesn't save the transaction and withdrawal information you shared with Stripes. Stripes have recorded the entire transaction history. For your transaction record safety, you can see the policy Stripes shared for their users here.
The payment method users have been using for making transactions for product buying doesn't have any save records by Dealfair; Stripes has handled all your transaction records.
- Regarding refunds, chargebacks, or payment reversals, Dealfair handles the processing and provides customer support related to Service-related queries but is not involved in disputes between Users.
- By agreeing to these Terms, you acknowledge your commitment to furnish accurate and timely information to Dealfair to adhere to our regulatory obligations while offering services to you. Furthermore, your acceptance of the Terms implies your acceptance of our Privacy Policy.
3. Seller Options: Sell, Auction, or Both
Dealfair offers sellers the flexibility to choose from three listing options: Sell, Auction, or Both. Sellers can opt to sell their products at a fixed price, auction them to the highest bidder, or utilize both methods to maximize their sales opportunities. By choosing the listing option that suits their products best, sellers can enhance their selling experience on Dealfair.
4. Listing Guidelines
When listing products on Dealfair, sellers must adhere to our listing guidelines. This includes providing accurate product descriptions, images, and pricing information. Any attempt to mislead buyers or engage in fraudulent activities will result in the immediate suspension of the seller's account.
5. Transaction Terms
For transactions conducted through the Dealfair Platform, buyers and sellers agree to complete the transaction promptly and in good faith. Sellers are responsible for shipping products promptly after the sale, and buyers are expected to make timely payments. Failure to comply with transaction terms may result in account suspension.
6. Fees and Payments
Dealfair may charge fees for certain services, such as listing fees or transaction fees. By using the Platform, you agree to pay any applicable fees and abide by the payment terms outlined in our fee schedule. Failure to pay fees may result in the suspension of your account.
In general, fees are incurred as follows:
- Shipping Fees: The shipping fee is payable by the Buyer or Seller, as determined at the time of listing. This fee may vary based on location or if a service like Dealfair is chosen. The final fee is conveyed during the transaction process. If our shipping carriers notify us or Dealfair is charged for postage due to incorrect shipping labels or weight classifications, we may deduct the carrier's fee from your Account balance or invoice you separately.
- Sales Fees: Dealfair charges Sellers a Sales Fee of 10% of the item purchase price for every completed sale.
- Transaction Fees: Sellers are subject to Payment Processing Fees, which include a rate of 2.9% of the combined item selling price, shipping price, taxes, plus a $0.35(fixed) fee per completed transaction. The shipping price refers to the buyer and Seller paid to ship using Dealfair labels and Dealfair Local delivery.
- Cancellation Fees: If a Seller cancels a transaction after it has been initiated but before completion, Dealfair may levy a cancellation fee of 5% of the item price, up to a maximum of $25. This fee will be subtracted from your balance or charged to the credit card on file within 30 days after notification.
- Taxes: When purchasing an item, surcharges may apply, including the item and shipping. These taxes vary based on the item's price, nature, and delivery location. Applicable taxes will be displayed to Buyers before final commitment to purchase.
7. Prohibited Activities
Users of the Dealfair Platform are prohibited from engaging in any unlawful, fraudulent, or harmful activities. This includes but is not limited to the sale of counterfeit goods, intellectual property infringement, and any activity that violates applicable laws or regulations.
8. Termination
If you wish to delete your account on Dealfair, you can contact us at [email protected] through the email you used while creating your Dealfair account and request your account deletion process. We will proceed with your request and take action as per our policy to make sure your request can be fully supported through our end.
Even after closing your account, you remain liable for any fees, shipping excesses, chargebacks/payment reversals, or refunds received by Dealfair. This responsibility persists beyond Account closure. Furthermore, you are obligated to assist in resolving any disputes with fellow Users arising from purchases or sales of goods made by you before Account termination.
9. Third Party Services and Linked Websites
The Privacy Policy governs your utilization of the Service, and by using the Service, you grant consent to the collection and utilization of your information, including personally identifiable information, by Dealfair. Our Service might include links to websites or services operated by third parties beyond our control or ownership (for example, links to Facebook payment services like Stripe), enabling you to transfer information to third-party services.
10. Other Reasons Deemed Appropriate by Dealfair
If a Buyer receives an item that is damaged, not as described, or needs to be corrected, they must report the issue to Dealfair within 72 hours. Additionally, refunds will generally be issued to the original form of payment. There are exceptions where a return of the item is unnecessary or ineligible for return, or the refund request is made after payment has already been processed to the Seller. It's important to note that refunds or returns are not provided for prohibited items.
Transactions in which payment is conducted outside of the Dealfair platform are strictly prohibited according to Dealfair's Terms. Such transactions do not qualify for Dealfair's protections or refunds. Listings or profiles that promote such transactions may be removed without prior notice. 11. Notice
If Dealfair determines that there is a need to notify or contact a User, it will do so by sending a text message, email, or letter to the email address or mailing address provided by the User. Alternatively, the notice may be displayed on the website. Dealfair shall not be liable for any damages incurred due to the fact that Dealfair’s notice or communication was not received or was delayed.
12. Changes to Terms
Dealfair may update these Terms from time to time. Any changes will be effective immediately upon posting the updated Terms on the Platform. It is your responsibility to review these Terms periodically for changes.
